
how much can i expect to recieve from my motorcycle accident settlement?
i was recently in a motorcycle/car accident where the driver of the car was at fault for the accident. My motorcycle was totaled and I went to the hospital that night to make sure that nothing was broken. i had some road rash and a sore leg, was prescribed painkillers and given crutches to use for the next few days. my main question is what should expect them to offer me in terms of paying for my medical expenses as well as pain, suffering, inconvienence and all of that stuff… any help would be greatly appreciated. oh ya, im all better now, but the bike is still jacked up (they totaled it, let me keep it and gave me more than it would have cost to get it fixed from the shop). oh ya, when i was at the hospital, they also took about 15 x-rays of my hip, knee and ankle to make sure everything was ok.
You mentioned “they gave you more than it would have cost to get it fixed from the shop.” This amount you cannot expect to be exceeded. In accepting the money, you have discharged them from at least those damages.
I say at least, because they can always say that in accepting their offer, you released them from everything. Of course you can say that you only accepted compensation for the physical damage to the bike, not the damage to your body and mind.
It was not unreasonable to go get checked out for hidden damage to your body. And therefore it is reasonable to ask for reimbursement for the cost of getting that done. Pain and suffering is usually not understood to be an issue in just getting checked out, but is an additional item, and hobbling around on a crutch should be an item then, also.
So you will have to talk to their lawyers, and indicate your bills, and documents regarding your pain and suffering and have them make an offer. It might be “Sue us.” So sue them.
